Terms of Service

These terms are a binding agreement between you and Pixbox. Please read them carefully — by creating an account or using Pixbox, you agree to them.

1. Agreement to these terms

These Terms of Service (the “Terms”) govern your access to and use of the Pixbox website, applications, and services (together, the “Service”). By creating an account, uploading content, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you are using Pixbox on behalf of a studio, business, or other organization, you represent that you are authorized to bind that organization to these Terms, and “you” refers to that organization.

If you do not agree to these Terms, do not use the Service.

2. Definitions

  • Photographer / Studio — a user who uploads, organizes, and delivers photos, whether to a host’s album or to their own portfolio or self-albums.
  • Host — the person or couple who owns an event album and invites a photographer to fill it. The host controls who can view, download, and share the album.
  • Guest — a person who is given access to view, and where permitted download, photos from an album.
  • Album / Event — a collection of photos and related content stored on the Service.
  • Content — any photos, videos, text, metadata, or other material that you upload to, create on, or transmit through the Service.

3. Eligibility and accounts

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity that occurs under your account. Tell us promptly at support@pixbox.io if you suspect any unauthorized use. We are not liable for losses arising from your failure to safeguard your account.

4. The Service

Pixbox is a photo box for events. The core of the product is a simple flip: the host owns the album, and the photographer is invited to fill it. Depending on your role and plan, the Service may include cloud photo and video storage, album organization, one-link sharing, granular per-photo and per-guest visibility controls, AI face detection and selfie-based matching, watermarks, bulk delivery, and curated photo pushes to Guestcard. We may add, change, or remove features at any time.

5. Your content and the rights you grant us

You retain all ownership of your Content. Uploading Content to Pixbox does not transfer any copyright or other ownership to us.

To operate the Service, you grant Pixbox a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for technical purposes such as resizing, format conversion, thumbnail generation, and AI face indexing), transmit, and display your Content — solely to provide, secure, and improve the Service for you and the people you authorize to access it. This license exists only to run the Service; it ends when you delete the Content or close your account, except for residual copies retained for a limited period in routine backups or as required by law.

You represent and warrant that you own or have the necessary rights, model releases, and consents for all Content you upload, and that your Content — and our authorized use of it — does not infringe or violate the rights of any third party or any law.

6. Roles, permissions, and sharing

Albums on Pixbox are role-aware. The host controls album-level visibility, download permissions, and guest access. A photographer invited to an album may upload and manage photos but does not gain ownership of the album. When you invite another person — a host, a co-photographer, or a guest — you are responsible for ensuring you have the right to share the relevant Content with them. You are responsible for the access levels you grant and for promptly revoking access you no longer intend to give.

7. Acceptable use

You agree not to use the Service to upload, store, share, or transmit Content that:

  • is unlawful, infringing, defamatory, or violates anyone’s privacy or publicity rights;
  • depicts the sexual exploitation or abuse of a minor, or any other content that is illegal to possess or distribute;
  • is malicious code, or is used to gain unauthorized access to any system or account;
  • harasses, threatens, or facilitates surveillance, stalking, or harm of any person, including misuse of facial-recognition features; or
  • violates any applicable law or these Terms.

You also agree not to resell, scrape, reverse engineer, overload, or circumvent the technical limits or security of the Service. We may remove Content or suspend accounts that violate this section.

8. AI face detection and matching

Where enabled, Pixbox uses automated facial detection and matching to help group photos and deliver a “photos of you” view to guests who opt in by taking a selfie. These features are provided to organize and deliver photos only. You agree not to use them for surveillance, identification of non-consenting individuals, or any unlawful purpose. AI results are probabilistic and may be incomplete or inaccurate; you should not rely on them as a definitive identification of any person. Our handling of facial data is described in the Privacy Policy, and you can request that facial data be deleted.

9. Plans, payments, and refunds

Pixbox is free for photographers to deliver photos. Paid offerings may include photographer storage subscriptions, Pixbox Pro, self-albums, host album purchases (one-time, forever access), album credits, and other features. Prices are shown at the point of purchase and may change with notice for future billing periods.

  • Subscriptions renew automatically until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period and does not retroactively refund amounts already paid, except where required by law.
  • One-time album purchases grant the access described at checkout. Because they unlock digital access immediately, they are generally non-refundable once the album is activated, except where required by law or stated otherwise.
  • Taxes may be added based on your location. Payments are processed by our third-party payment processor; we do not store full card details.

10. Storage, downgrades, and “forever” albums

Storage allowances depend on your plan. If you exceed your allowance or your payment lapses, we may restrict uploads or, after notice, restrict access to or remove Content. Host album purchases are designed for long-term access (“forever albums”); “forever” means we intend to preserve the album for the life of the Service and will give reasonable advance notice and an export opportunity before any discontinuation. It does not guarantee perpetual operation of the Service or survive deletion by an authorized owner.

11. Intellectual property

The Service itself — including the Pixbox name, logo, software, and design — is owned by us and our licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the Service as permitted by these Terms. If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you.

12. Third-party services

The Service relies on third-party providers for hosting, storage, payments, authentication, email, and analytics. Your use of features that depend on these providers may also be subject to their terms. We are not responsible for third-party services we do not control.

13. Copyright complaints and takedowns

We respect intellectual-property rights and respond to valid complaints. If you believe Content on Pixbox infringes your copyright, email support@pixbox.io with: your contact information; a description of the work and the allegedly infringing material (including a link); a statement that you have a good-faith belief the use is unauthorized; and a statement, under penalty of perjury, that the information is accurate and that you are the rights holder or authorized to act for them. We will review valid notices and may remove the Content and, in appropriate cases, terminate repeat infringers.

14. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Where practical, we will give notice and, for paid accounts not terminated for cause, a reasonable opportunity to export your Content. On termination, the licenses you granted us end (subject to routine backups and legal retention), and Content may be deleted.

15. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, secure, error-free, or that Content will never be lost. You are responsible for keeping your own copies of important photos. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

16. Limitation of liability

To the maximum extent permitted by law, Pixbox and Lysensy Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, photos, profits, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or CAD $100.

17. Indemnification

You agree to indemnify and hold harmless Pixbox, Lysensy Inc., and our personnel from any claims, damages, and reasonable costs (including legal fees) arising from your Content, your use of the Service, or your breach of these Terms or of any third party’s rights.

18. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in Ontario, Canada for any dispute not subject to binding arbitration, and otherwise to resolve disputes in your place of residence where the law requires. Nothing here limits consumer-protection rights you have under the laws of your home jurisdiction.

19. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the revised Terms.

Pixbox is a product of Lysensy Inc., a corporation incorporated under the laws of Canada. References to “Pixbox,” “we,” “us,” and “our” in these Terms mean Lysensy Inc. operating the Pixbox service.
